Tasman Rope Access was recently invited by a client to present to a range of employees and energy resources contractors regarding the current legalities of fatigue management. The presentation highlighted varying statutory law contradictions, common law case findings, arbitral award decisions and potential risks for organisations for ‘psychosocial hazards’ and the updated risk management requirements for mental health and welfare.
The presentation outlined the legislative and ethical requirements for effective governance over worker fatigue from PCBU’s, officers, employees, contractors, regulators and insurers under both the national Fair Work Act and varying State and Territory OHS/OSH/WHS Acts.
